Do I have a claim?

You may have a claim against your landlord or agent if any of the following apply:

  • Your deposit was not protected in a government-approved scheme within 30 days.
  • You did not receive the prescribed information within 30 days.
  • Your deposit was protected late or moved between schemes without notice.
  • Your landlord failed to return your deposit when required without a valid reason
  • Your landlord made unlawful deductions from your deposit before your deposit payment was returned.

What compensation could I receive?

The Court can order your landlord to pay a penalty of 1 to 3 times the amount of your deposit, depending on the seriousness of the breach.
